Terms for using Gemini Solutions' website, platform, mobile applications, and related services.

These Terms of Service ("Terms") govern your access to and use of the website www.geminishale.com, Gemini's online workplace and platform, associated mobile and desktop applications, and related services (collectively, the "Services"). The Services are operated by Gemini Shale Solutions LLC ("Gemini", "Company", "we", "us", or "our").
By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
If you or your organization has entered into a separate written agreement with Gemini, that agreement controls to the extent it conflicts with these Terms.
You may use the Services only for lawful business purposes and in accordance with these Terms, applicable documentation, and any account permissions assigned to you. You are responsible for ensuring that your users, employees, contractors, and representatives comply with these Terms when accessing the Services on your behalf.

Some parts of the Services require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify Gemini promptly if you suspect unauthorized access or misuse of your account.
Gemini may suspend or restrict access to the Services if we reasonably believe an account is being used in violation of these Terms, creates a security risk, or may cause harm to Gemini, our customers, or third parties.
As between you and Gemini, you retain ownership of data, records, tickets, files, and other content you or your authorized users submit to the Services ("Customer Data"). You grant Gemini the rights needed to host, process, transmit, display, and use Customer Data to provide, secure, support, and improve the Services.
You are responsible for the accuracy, quality, legality, and authorization of Customer Data submitted through the Services. Gemini's handling of personal information is described in our Privacy Policy.
The Services, website content, software, designs, workflows, documentation, trademarks, logos, and other materials provided by Gemini are owned by Gemini or its licensors and are protected by intellectual property laws. Except for the limited right to use the Services under these Terms or another written agreement, no rights are transferred to you.
The Services may connect with third-party systems, applications, devices, maps, analytics tools, app stores, or customer systems. Gemini is not responsible for third-party services that are not controlled by Gemini, and your use of those services may be governed by separate terms and policies.
The Services are provided on an "as is" and "as available" basis except as expressly stated in a separate written agreement. Gemini does not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
Operational, compliance, ticketing, billing, and reporting outputs should be reviewed by qualified personnel before being relied on for business, accounting, regulatory, or safety decisions.
To the maximum extent permitted by law, Gemini will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of the Services.
Gemini may update these Terms from time to time. When we make changes, we will update the review date on this page. Your continued use of the Services after changes are posted means you accept the updated Terms.
